Part 1 - Platform General Terms and Conditions
1. Introduction
1.1 Astra Digital Holding Ltd is a private company limited by shares incorporated and registered in the Abu Dhabi Global Market with registration number 6563 whose registered office is at DD-15-134-004-007, level 15, Wework Hub71, Al Khatem Tower, Abu Dhabi Global Market Square, Al Maryah Island, Abu Dhabi, United Arab Emirates, whose group in includes Algento DMCC, Botim Money Technology LLC, and Quantix Technology Projects LLC (collectively Astra Tech, we, us, and our).
1.2 These platform terms and conditions (Platform Terms) cover the terms and conditions under which we offer you access to the Astra Tech suite of products and services (Services) through our websites and applications, including the Botim App Services (as defined below), the Wallet Services (as defined below), the Card Services (as defined below), and the Lending Services (as defined below), provided through Botim.me and Quantix.ai and mobile applications (Android & iOS) (collectively, the Platform), and contain:
- Part 1 – Platform General Terms and Conditions: applicable to your use of all Services and the Platform;
- Part 2 – Terms and Conditions for Botim App Services: applicable to the establishment and operation of an account (Account) for the use of the Botim App Services;
- Part 3 – Terms and Conditions for Wallet Services: applicable to the establishment and operation of a Botim Money digital wallet (Botim Money Wallet) for the use of the Wallet Services;
- Part 4 – Terms and Conditions for Card Services: applicable to the issuance and operation of virtual and physical cards (Cards) issued as part of the Card Services;
- Part 5 – Terms and Conditions for Lending Services: applicable to the establishment of loans under the Lending Services (Loan); and
- Part 6 – Glossary.
1.3 If you accept or agree to these Platform Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Platform Terms and, in such event, you and your will refer and apply to that company or other legal entity.
1.4 YOU SHOULD READ THESE PLATFORM TERMS CAREFULLY BEFORE USING THE SERVICES OR REGISTERING AN ACCOUNT AND DETERMINE WHETHER THESE PLATFORM TERMS ARE APPROPRIATE TO YOU GIVEN YOUR PERSONAL OR FINANCIAL CIRCUMSTANCES. IF YOU DO NOT AGREE WITH THESE PLATFORM TERMS, YOU SHOULD CEASE YOUR USE OF THE SERVICES IMMEDIATELY.
1.5 By installing, accessing, downloading, or otherwise using the Platform and/or any Services, you are agreeing to comply with, and be bound by, these Platform Terms. If you breach or violate any of the Platform Terms, we have the right to block your access to the Platform and Services immediately and you will not be permitted to access the Platform or any Services, without our permission.
1.6 These Platform Terms are to be read in conjunction with, and are subject to, our [privacy policy – link] and any additional agreement (such as a Credit Agreement, as defined below) you may be required to execute with us in order to receive specific Services. Where you agree to accept or make use of our Services, your binding agreement will be with the applicable Astra Tech subsidiary licensed to provide the relevant Service, as set out below. If you do not agree and accept, without limitation or qualification, these Platform Terms, you must cease using the Services and exit the Platform immediately.
2. Changes to These Platform Terms
2.1 We can make updates to these Platform Terms at any time. We will let you know of any changes to the Platform Terms via the Platform, or through another medium of using the Services. We may make some kinds of changes that are effective immediately, without telling you in advance, including; (i) where the applicable laws allow us to make immediate changes; or (ii) where we are required to make a change due to legal and/or regulatory requirements and there is not time to give you prior notice of such changes.
2.2 Where we are required to give you prior notice, the updated Platform Terms will come into effect sixty (60) calendar days after we have given you notice, unless you have given us notice that you object to the proposed changes. Your continued use of the Platform and/or Services will be deemed acceptance of the updated Platform Terms.
2.3 If you object to the updated Platform Terms, such objection shall constitute a notice by you that you wish to close your Account, Card, Botim Money Wallet and any other Services you are accessing in accordance with your rights under Clause 17.

4. Eligibility, Registration and Security
4.1 Once you have downloaded the Platform, we need to set up your Account before you can fully access the Services. In order to provide you with an Account, you must prove to us you are eligible by providing correct and up to date information demonstrating the eligibility requirements that we and applicable laws require.
4.2 You agree to provide accurate, current, and complete information about yourself during the registration process and to promptly update your account information as necessary to keep it accurate, current, and complete.
4.3 In addition to the above, to be eligible to make use of the Wallet Services, Card Services, and/or the Lending Services:
- you must be at least 18 years of age (or 21, depending on the specific Service);
- you must be a resident of the UAE;
- you must provide us with your Emirates ID and any other documentation we request. We will also require that you provide a “real time” video of yourself via the Platform (using your device camera and microphone) to validate your identity. For more information on how we use the personal data please read our Privacy Policy; and
- you agree that any payment obligations arising from the Services provided to you will be met by you pursuant to the payment terms applicable to those Services, including where relevant, in the applicable Credit Agreement.
4.4 You agree to accept responsibility for all activities that occur under your Account, Card, and/or Botim Money Wallet or through the use of your password. You are responsible for maintaining the confidentiality of your Account, Card, Botim Money Wallet, and password and for restricting access to your devices used to access the Platform, and any Services. You should not let another person use your device or your Account, Card, or your Botim Money Wallet as this could increase the risk of fraud or misuse. If you receive a Card as part of the Services, you must not disclose information regarding your Card (including disclosure of your personal identification number (PIN) or any password, as applicable) to any other person. If you think you have been a victim of fraud or the Services have been used without your permission (including if you believe that your Account has been hacked, compromised or breached in any way), please contact us immediately by email at customerservice@botim.me or via the Platform.
5. General Platform Conditions
5.1 In addition to any other provisions included in these Platform Terms, you agree that your access to the Platform, your Account, and any Services we offer is subject to:
- Operating System: the Platform requires your device to be operating with at least version iOS 9 (for Apple devices) and Android 5 (for Android devices) with a minimum of 200 MB of memory.
- Updates: When an update of the Platform becomes available, you are strongly encouraged to download this as soon as possible following its release. Updates are created to improve the Platform and the user experience. If you do not update the Platform, it may no longer be supported by us and, over time, will likely depreciate in functionality.
- Device Fees: You are wholly responsible for all carrier data plan and other applicable fees and taxes associated with your device.
- Unauthorised Transactions: You must contact us immediately by email at customerservice@botim.me or via the Platform if there is a transaction on your Account that you do not recognize or which you think is incorrect.
- Deleting the Platform: You must not delete the Platform (or any of our Apps available through the Platform) until your Account has been closed in accordance with these Platform Terms.
- Electronic Communications: By opening an Account and/or using any of the Services and providing your email address and/or mobile number, you consent to receive electronic communications from us, including notifications, confirmations, disclosures, and other information related to your Account, transactions, and use of the Services. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
6. Promotions and Referral Programs
7. Fees and Payments
7.1 You are responsible for any and all fees and charges associated with any Services that you use. By using the Services, you authorise us to initiate payments from your designated payment account for all amounts due to us in connection with the Services. Some Services may attract additional fees and charges and will be subject to specific repayment and auto-debit arrangements, please refer to Part 3 – Terms and Conditions for Wallet Services, Part 4 – Terms and Conditions for Card Services, and Part 5 – Terms and Conditions for Lending Services, for further details.
8. Availability Through Third Party Applications
8.1 These Platform Terms also apply to the extent the Services are made available through other applications, platforms, or services. By accessing or using the Services through such other applications, platforms, or services, you acknowledge and agree to be bound by these Platform Terms, and you represent and warrant that your use of the Services on or through such other applications, platforms, or services complies with any applicable terms and conditions of those applications, platforms, or services.
9. Acceptable Use
9.1 When using the Platform and any Services, you must always do so for legal, authorised, and acceptable purposes. When using the Services you will not, nor permit any person using your Account, Card, Botim Money Wallet and/or accessing the Platform to:
- use the Services in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with or in breach of these Platform Terms;
- violate or infringe the rights of Astra Tech, any of our group companies, our users, or other third parties, including rights in respect of privacy, intellectual property, or other proprietary rights;
- provide false, inaccurate, or misleading information;
- engage in any potentially fraudulent or suspicious activity and/or transactions, including receiving money which may be fraudulent or adding money to your Botim Money Wallet or Card which may be linked to criminal activities;
- refuse to cooperate with an investigation or provide any information we request, including with respect to verifying your identity;
- transmit any communication, material or other content that is illegal, obscene, defamatory, threatening, intimidating, harassing, hateful, racially, or ethnically offensive, or which could instigate or encourage conduct that would be illegal or otherwise inappropriate, including promoting violent crimes;
- impersonate someone;
- seek to harm Astra Tech, our group companies, or any of our users or customers; or
- access, use, copy, modify, distribute, display, otherwise exploit or prepare derivative works based upon our Services in impermissible or in an unauthorised manner, or in ways that harm us, our group companies, the Platform, our Services, systems, users, or others. In particular you must not, nor permit any person accessing the Platform or using your Account, Card, or Botim Money Wallet to:
- reverse engineer, alter, modify, create derivative works from, decompile, or extract code from our Platform, except to the extent permitted by law;
- send, store, or transmit viruses or other harmful computer code through or onto our Platform;
- gain or attempt to gain unauthorised access to our systems or those of our group companies;
- create accounts for our Services through unauthorised means;
- collect the information of or about our users in any impermissible or unauthorised manner;
- sell, resell, rent, or charge for the use of, our Services;
- use the Services and any applications made available to you for any illegal purposes or purposes that these are not intended to be used for;
- to avoid complying with age restrictions applicable to the Services;
- engage in any activity that would potentially exploit children, promote violence, terrorism, extremism, or hate;
- engage in activity that could lead to or be considered as a misrepresentation, fraud, or manipulation of any party;
- emit or transmit any virus or bug to affect the Platform or any Services;
- infringe the intellectual property rights of others by sharing content that may be infringing third party copyright (either registered or not registered);
- publicly display or use the Services to share inappropriate content or material (for example, involving nudity, pornography, offensive language, graphic violence, or criminal activity);
- engage in phishing or sending or distributing unsolicited communication to other persons or entities or violate the privacy rules of others, such as marketing or spamming by contact requests, messages, or calls;
- promote, support, or encourage illegal consumption of alcohol or tobacco;
- attempt to circumvent any restrictions on access to or availability of the Services; or
- use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc. or “load testers” such as wget, apache bench, mswebstress, httpload, blitz, etc., which access the Services in a manner that sends more request messages to the Botim servers in a given period of time than a human can reasonably produce in the same period by using a Botim application and not to digitally extract the content, unless specifically allowed.
9.2 Notwithstanding the foregoing, we grant the operators of public search engines permission to use spiders to copy materials from the certain part of the Platform for the sole purpose of creating publicly available searchable indices of the materials but not caches or archives of such materials. We reserve the right to revoke these exceptions either generally or in specific cases. We expressly disallow any efforts to reverse-engineer systems, protocols, or explore outside the boundaries of the normal requests made by our users. We do not permit the use of request modification tools such as fiddler or whisker, or the like, or any other such tool activities that are meant to explore or harm, penetrate, or test the site. You must secure our prior written permission before you measure, test, health check or otherwise monitor any network equipment, servers or assets hosted on the Services. You also agree not to collect or harvest any personally identifiable information, including account names, from the Services.
10. Licenses and Intellectual Property
10.1 What we own. Throughout our relationship with you, we retain ownership and/or control, as appropriate, of the Services and Platform and all intellectual property rights therein, including all copyrights, trademarks, domains, logos, trade secrets, patents, and other intellectual property rights that have existed, do, may or will exist in the future (Intellectual Property). You may not use our Intellectual Property unless permitted under these Platform Terms or with our express written consent (which you can seek by contacting us by email at customerservice@botim.me or via the Platform).
10.2 What you own. Throughout our relationship with you, you retain ownership of the details, information, or other data you submit for your Account, Card, Botim Money Wallet or through the use of our Services.
10.3 In order for us to provide you with access to the Platform and/or our Services to the best of our ability, you grant us a worldwide, free of charge, sublicensable, and transferable right to use, reproduce, distribute, create derivative works of, and display the information (including any content) that you upload, store, send, or receive on or through the use of the Platform and/or Services. We will only use such rights for the limited purpose of providing our Services which includes, for example, to allow us to display your profile picture.
10.4 In order for you to access the Platform and/or receive the Services at the best standard, we grant you a revocable, non-exclusive, non-sublicensable and non-transferable right to use the Platform and Services for the sole purpose for which they were created, subject to and in accordance with these Platform Terms. No other rights are granted to you by implication or otherwise.
10.5 If you believe our Intellectual Property is being infringed by a third party, please contact us immediately using the contact details provided above. If we believe you are infringing (or otherwise misusing) our Intellectual Property or the intellectual property of another, we may terminate your Account and access to any Services with immediate effect.
11. Disclaimer
11.1 Your use and acceptance of the Platform and any Services is at your own risk and at all times subject to the following disclaimers:
- the Platform and Services are provided on an “as is” basis without any express or implied warranties;
- no warranty is given that any information provided by us is accurate, complete, or useful, that the Platform and Services will be operational, free from errors, secure, safe, or that the Platform and Services will function without disruptions, delays, or imperfections;
- we do not control, and are not responsible for controlling, how or when our users use our Platform and Services; and
- we are not responsible for and are not obligated to control the actions or information (including content) of our users or other third parties.
11.2 The forgoing disclaimers will apply to the fullest extent permitted by applicable law.
12. Your Liability
- your access to or use of our Platform and/or Services;
- your breach of these Platform Terms; or
- any misrepresentation made by you.
13. Our Liability
13.1 We accept liability where we act on a payment instruction as part of the Services and this is not received by your payee’s bank (whether that be a merchant, another Account holder, or the person/organization to which you must pay a bill), except where this is a result of yours, your payee’s, or your payee’s bank’s (not with respect to another Account holder) negligence (for example, if you included the wrong payee details), fraud or wilful default.
13.2 Unless expressly stated otherwise in these Platform Terms, we, our affiliates, subsidiaries, directors, employees, partners and agents, will not be held liable to you, whether in contract (including under any indemnity), tort (including negligence), under statute or otherwise, under or in connection with these Platform Terms, your activities under your Account, your Botim Money Wallet, your Card, your use of the Platform and/or our provision of any of our Services, for any:
- consequential, indirect, or special losses or damages;
- loss of profits, loss of business or loss of business opportunity;
- loss as a result of any failed payment due to insufficient funds in your Account;
- losses incurred as a result of abnormal or unforeseeable circumstances outside our reasonable control, including delays or failures caused by problems of another system or network, mechanical breakdown, industrial action, or a pandemic;
- losses incurred where a law, or guidance or instruction from a governmental authority, requires us to take action, for example to terminate these Platform Terms and close your Account, your Card, or your Botim Money Wallet; or
- any other loss or damage to the extent that such loss or damage is caused or contributed to by you or is a result of the failure by you to comply with these Platform Terms.
13.3 For any losses or damages for which we are found liable, our aggregate liability towards you for all claims during our relationship with you shall not exceed AED 500.
13.4 These exclusions and limitations of liability will apply to the fullest extent permitted by applicable law.
14. Consent to Collecting and Providing Personal Information
14.1 To enable you to use the Platform and/or the Services we must collect, store, use, share and otherwise process your personal data. No credit or debit card details or personally identifiable information will be stored, sold, shared, rented, or leased to any third parties except as otherwise set out in our Privacy Policy and these Platform Terms. To learn more about why and how we do this, please read our Privacy Policy. It will also provide useful information about the rights you may have in relation to your personal data and how you may be able to exercise such rights.
14.2 By using the Services and providing your personal information to us, you expressly consent to the collection, use, storage, and processing of your personal information by us, subject to our Privacy Policy.
14.3 As a licensed financial institution in the UAE, we are required, when providing certain Services, such as the Lending Services, to report certain personal and credit transaction information to the authorities, including but not limited to your name, outstanding loans, and repayment history. Please refer to Part 5 – Terms and Conditions for Lending Services for further detail on the information requirements for Lending Services.
14.4 You understand that we may also share your personal information with third parties, as described in our Privacy Policy, for the purpose of providing the Services, enhancing your user experience, and complying with applicable laws and regulations. By registering for an Account, opening a Botim Money Wallet, receiving a Card, or using any of the Services, you confirm that you have read, understood, and agreed to the terms of our Privacy Policy, which is incorporated into these Platform Terms by reference.
15. Artificial Intelligence Warning
15.1 You acknowledge and agree that, to the extent we elect to employ or otherwise rely upon artificial intelligence–enabled technologies, machine-learning systems, large language models, generative tools, automated decision-making software, or any similar or successor functionality (collectively, AI Tools) in the course of providing the Services, the following provisions of this clause 15 shall apply and shall govern, supersede and prevail over any inconsistent term elsewhere in these Platform Terms.
15.2 Nature of AI Output. AI Tools generate content probabilistically and at speed, frequently relying on third-party data sets that may be incomplete, outdated, biased, or otherwise unreliable. Accordingly, all text, analyses, data, images, audio-visual materials, recommendations, statistics, code, or any other output or derivative work produced, suggested, or assisted by AI Tools (together, AI Output) are provided solely on an “as is” and “as available” basis for preliminary, non-binding informational purposes. AI Output does not constitute legal advice, professional advice of any kind, or a definitive statement of fact, law, or policy, and shall not be relied upon without independent human review and verification by suitably qualified personnel.
15.3 Accuracy, Completeness, and Currency. Astra Tech does not represent, warrant, or guarantee that AI Output will be accurate, complete, current, free of errors, stereotypes, or omissions, suitable for any particular purpose, or compliant with applicable law, regulation, or professional standards. You accept full responsibility for validating the accuracy and appropriateness of all AI Output and for obtaining such specialist or professional advice as you considers necessary before acting or refraining from acting.
15.4 Intellectual Property and Third-Party Rights. AI Output may incorporate, reproduce, transform, or otherwise implicate intellectual property rights, proprietary data, or confidential information owned or controlled by third parties. Astra Tech makes no representation that the creation, use, dissemination, or exploitation of AI Output will not infringe or misappropriate any patent, trademark, copyright, moral right, database right, trade secret, or other intellectual property or proprietary right. You undertake to indemnify and hold Astra Tech harmless from and against all liability, loss, damage, cost, or expense (including reasonable legal fees) arising out of or in connection with any such infringement or misappropriation.
15.5 Confidentiality and Data Protection. While we take reasonable steps to configure AI Tools so as to preserve the confidentiality of your personal data and to comply with applicable data-protection laws, you recognise that AI Tools may process, transmit, store, reproduce, or otherwise expose inputs or prompts, including personal data and confidential information, to external servers, service providers, or other environments not wholly controlled by Astra Tech. You therefore agree: (a) to refrain from providing any personal data, special-category personal data, export-controlled data, or information that is subject to legal privilege, secrecy obligations, or insider-trading restrictions within any prompt or input furnished to an AI Tool, and (b) that, to the extent you do provide such information, you do so entirely at your own risk.
15.6 Regulatory Compliance. AI Tools may be subject to domestic and foreign laws and regulations governing, inter alia, automated decision-making, algorithmic accountability, export control, sanctions, and sector-specific compliance. Astra Tech does not warrant that the utilisation of AI Tools or AI Output is compliant with any such laws or regulations, and you shall bear sole responsibility for ensuring that its use, distribution, or commercialisation of AI Output accords with all applicable legal and regulatory requirements.
16. Complaints and Customer Support
16.1 We are committed to providing quality services and addressing any concerns or complaints you may have in a timely and efficient manner. If you have any complaints or concerns about the Services or any aspect of your experience with Astra Tech, please contact our customer support team by emailing us at customerservice@botim.me. We will acknowledge receipt of your complaint and strive to resolve the issue as quickly as possible. In your email, please provide a detailed description of your complaint or concern, along with any supporting documentation or information that may assist us in resolving the matter.
17. Termination of These Platform Terms
17.1 Some provisions of these Platform Terms will continue to apply to you even after you close your Account, Card, or Botim Money Wallet or cease using the Services. These include: Clause 10 (Licenses And Intellectual Property), Clause 11 (Disclaimer), Clause 12 (Your Liability), Clause 13 (Our Liability), Clause 17 (Termination Of These Platform Terms), Clause 27 (Notices) and Clause 28 (Dispute Resolution And Governing Law).
17.2 We may, at any time, block your access to the Platform and disable your Account, your Card, and/or Botim Money Wallet (either indefinitely or for a set period of time) and/or terminate your access and use of any or all of the Services if any of the following occur:
- we suspect you are using the Services, or permitting your Account, Card, or Botim Money Wallet to be used for criminal or fraudulent purposes;
- we suspect someone is using your Account , Card, or Botim Money Wallet without your authority;
- we do not have sufficient information to operate your Account, Card or Botim Money Wallet or provide you with a Service, including up to date contact and identification information;
- we identify that you were not eligible to open your Account, your Card, your Botim Money Wallet or to receive any of the Services;
- your behaviour towards our staff makes it difficult for us to deal with you;
- you do not accept any updated versions of these Platform Terms;
- you do not pay any interest, fees or charges owed on time;
- you go into bankruptcy, enter into an individual voluntary arrangement, have a debt relief order, or trust deed lodged against you or enter into any other form of analogous circumstances;
- you die; or
- we suspect you have violated these Platform Terms.
17.3 You can close your Account, Card and Botim Money Wallet at any time by contacting us via the Platform or by emailing us at customerservice@botim.me.
17.4 On closure of your Account, Card, and/or Botim Money Wallet, we will transfer any remaining funds to an account with another bank or send a cheque to the address we hold for you at the time of closure. If you want to close your Account, Card, Botim Money Wallet, or cease using any of the Services but still owe us money, we may keep your Account and/or Botim Money Wallet (as applicable) open and seek to recover the money from you using our standard recovery procedures.
17.5 If any of the events listed above happen, you (or your estate) are responsible for cancelling all payments in and out of your Account, Card and Botim Money Wallet and deleting the Platform from your device.
18. Language
18.1 These Platform Terms were prepared in English and therefore the default language is English. Should you wish to access these Platform Terms in a different language, please update the language setting on your device to the preferred language. Please note that not all languages are available and should there be any discrepancies or differing interpretations or meanings between the English version of these Platform Terms and any translation, the English language version of the Platform Terms shall prevail.
19. Assignment
19.1 You may not assign, transfer, or delegate your rights or obligations under these Platform Terms without our prior written consent. We may assign, transfer, or delegate our rights and obligations under these Platform Terms, in whole or in part, without your consent, to any affiliate or in connection with a merger, acquisition, sale of assets, or other business transaction.
20. Force Majeure
20.1 Neither party shall be liable for any failure or delay in performance under these Platform Terms (other than payment obligations) if such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, pandemics, government regulations, strikes, or communication or utility failures.
21. Waiver
21.1 No waiver of any provision of these Platform Terms shall be effective unless it is in writing and signed by the party against whom it is sought to be enforced. The failure of either party to exercise or enforce any right or provision of these Platform Terms shall not constitute a waiver of such right or provision.
22. Severability
22.1 If any provision of these Platform Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions of these Platform Terms shall continue in full force and effect, and the invalid, illegal, or unenforceable provision shall be deemed replaced by a valid, legal, and enforceable provision that most closely accomplishes the original intent of the parties.
23. Entire Agreement
23.1 These Platform Terms, together with the Privacy Policy and, where applicable any Credit Agreement, and any other statement of fees, limits, policies or guidelines referenced herein, constitute the entire agreement between you and us with respect to your use of the Platform and the Services and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral, relating to the subject matter hereof.
24. No Third-Party Beneficiaries
24.1 Except as expressly provided in these Platform Terms, there are no third-party beneficiaries to these Platform Terms, and no person or entity other than you and Astra Tech shall have any rights or remedies under these Platform Terms. For the avoidance of doubt, a person who is not a party to the agreement between you and us with respect to your use of the Platform and the Services has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of, or enjoy any benefit under, these Platform Terms.

25.1 The headings in these Platform Terms are for convenience only and shall not affect the interpretation or construction of any provision of these Platform Terms.
26. Local Law Violations
26.1 The Platform and our Services should not be accessed or otherwise used in any jurisdiction where the Platform or any or all of the Services are prohibited to any degree.
27. Notices
27.1 Any notices or other communications required or permitted under these Platform Terms shall be in writing and shall be deemed given when delivered personally, sent by registered or certified mail (postage prepaid, return receipt requested), or sent by email (with confirmation of receipt) to the addresses or email addresses provided by each party during the account registration process or as updated by either party from time to time.
28. Dispute Resolution and Governing Law
28.1 We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, please see the following as to how it can be resolved and what laws will apply.
28.2 Unless expressly required otherwise by law, these Platform Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Platform Terms or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.
28.3 We both agree that the courts of the Abu Dhabi Global Market in Abu Dhabi shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Platform Terms or the subject matter or formation.
Part 2 – Terms and Conditions for Botim App Services
29. Access to Botim App Services
29.1 The Services related to the offering and operation of the Botim mobile application (Botim App) (as described in this Part 2 – Terms and Conditions for Botim App Services comprising the Botim App Services) are provided by Algento DMCC (Botim), a private limited company incorporated and registered under the laws of the Dubai Multi Commodities Centre with company number DMCC-532203 whose registered office is at 8H, 8th Floor, Gold Tower, Jumeriah Lake Towers, Dubai, UAE. When you use the Botim App Services you are contracting with Botim.
29.2 Subject to your compliance with these Platform Terms, we grant you permission to open an Account and use the Botim App Services.
29.3 In order to gain access to any paid third-party provided services, you expressly agree to comply with the relevant third-party’s terms and conditions in relation to the payment processing services, as further set out in the “Third Party Content and Services” section below.
30. Account Statements
30.1 We will inform you of all transactions on your Account as they occur via the Platform. We will also provide you with record of all transactions that have occurred in your Account via the Platform.
30.2 You are responsible for informing us if your contact or identification information changes or confirming such information to us at our request.
31. Paid Features
31.1 Certain features of the Botim App Services, such as upgrading to a premium account, may require you to pay a separate fee in order to use them. If you choose to purchase these features, you expressly authorise us or a third-party payment processor to charge the payment method you provide for the applicable fee. All fees are non-refundable.
32.2 We offer auto-renewing one (1) month and one (1) year in-app subscriptions for premium advertisement free experience and other benefits. Once you purchase these features and use all or any of them, or cancel your account before using all of them, you will not be entitled to a refund from us. We reserve the right to terminate or suspend your use of paid features of the Botim App Services at any time and for any reason, without liability.
31.3 We may change the price of paid features at any time and if you have a subscription with a fixed end date, you can continue to use the benefits of such paid features until the end of the subscription period without changes. If you do not agree to the new price at which the payable features are offered, you do not have to renew or extend your subscription.
31.4 If you are required to make a payment for any features of the Botim App Services, such payment shall be processed via a payment facility provided by a third-party payment facility provider. We shall not be liable for any errors, failures or other faults within the payment process or any payment related data that is being transmitted or received during such payment process as we have no access to such data and process and we are not involved in collection or storing any such payment related data. Should you have any issues with processing the payment please contact customerservice@botim.me.
32. Third-Party Content And Services
32.1 Information provided or shared by the users of the Botim App Services may contain links to third-party websites that are not owned or controlled by us. We have no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party websites. In addition, we will not, and cannot, censor or edit the content of any third-party sites. By using the Botim App Services, you expressly acknowledge and agree that we shall not be responsible for any damages, claims or other liability arising directly or indirectly from or related to your use of any third-party websites.
32.2 The Botim App allows for third parties to advertise their services and allows the users to avail third-party services using the Botim App. The Botim App also uses Mini Programs within the Botim App Services. “Mini Programs” are sub-applications within the Botim App. We may also make available through the Botim App other types of content or news. We are not responsible for and we do not endorse, support, or guarantee the lawfulness, accuracy, reliability, functionality, or relevance of any such news, advertisements, third party services, Mini Programs, or content, displayed, submitted to, transmitted by, or made available while using the Botim App Services.
32.3 You acknowledge and agree that by using the Botim App Services, you may be exposed to content which may be inaccurate, misleading, defamatory, offensive, hurtful, or unlawful. Any reliance on or use of any content that is made accessible via the Botim App Services is solely at your own risk. You expressly undertake to release us of any liability in relation to use and reliance on any third-party content made available through the Botim App Services. We shall not be responsible or liable for the performance of any third-party advertising their services on the Botim App. Any complaints you may have in relation to the content or services that you may obtain or fail to obtain from third parties shall only be made against such third parties and not against us. Your use of the Botim App Services does not give you any rights in or to any third-party content you may access to or obtain in connection with your use of the Botim App Services.
32.4 We do not guarantee the quality, reliability or suitability of any third-party services, programs (including any Mini Programs) or websites provided, made available, advertised or linked through the Botim App (including any other associated platforms or services available through the Platform) and we bear no responsibility for your use of or relationship with any such third-party service providers, programs or websites, including any payment obligations or fees that you may incur in your use of such third-party services or websites.
32.5 We may review (but makes no commitment to review) content (including any content posted by users of the Botim App Services) or third-party programs or services made available through the Botim App Services to determine whether or not they comply with our policies, applicable laws and regulations or are otherwise objectionable. We may, in our sole discretion, at any time remove or refuse to make available or link to certain content or third-party programs or services, if they infringe intellectual property rights, are obscene, defamatory or abusive, violate any rights or pose any risk to the security or performance of the Botim App, the rest of the Platform or any other Services available through the Platform.
32.6 There may be, from time to time, third-party content, programs, and/or services on the Botim App that are subject to further terms from that third-party. For example, these could be terms from relevant third-party that originally produced or created content or service, terms in relation to promotional activities being held via the Botim App, terms relating to your use of third party-provided service using Botim App login functionality or terms governing your use of any Mini Programs provided by a third-party. You are solely responsible for reviewing and complying with any such third-party terms and conditions.
32.7 We retain the right to remove, at our sole discretion and without notice to you, any content, programs, and/or services that are made available within the Botim App (including any other associated platforms or services available through the Platform) in accordance with these Platform Terms.
33. User Status and Direct Messages
33.1 The Botim App Services allows users to submit User Status and Direct Messages. For the purposes of these Platform Terms, “User Status” refers to profile photo and other communications other than Direct Messages submitted by you, as well as the automatic submission of your “last seen” status. You are solely responsible for any User Status that are displayed for your phone number. “Direct Messages” for the purpose of these Platform Terms, refers to text, voice, photo, video, location and contact information messages you send directly to other users or groups of the Services.
33.2 The User Status and Direct Messages may be hosted, shared, and/or published as part of the Botim App Services, and may be visible to other users of the Botim App Services who have your mobile phone number in their mobile phone and which you have not expressly blocked. Direct Messages will only be viewable by those Botim App Services users or groups you directly send such information to but the User Status may be globally viewed by the users of the Botim App Services that have your mobile phone number on their phone, unless the user is blocked by you.
33.3You acknowledge and agree that any User Status may be globally viewed by other users that have your mobile phone number. For this reason, you should not submit User Status that you would not want to be seen globally. The submission of your ‘last seen’ status is done on an automatic basis. As clarified in the following section, you retain your ownership rights in your User Status. You understand that whether such User Status are published, we do not guarantee any confidentiality with respect to any such submissions.
33.4 You are solely responsible for your own User Status and Direct Messages and the consequences of posting or publishing them. We are only acting as a repository of data; the User Status and Direct Messages do not represent the views or opinions of Astra Tech or any member of the Astra Tech group of companies. We make no guarantees as to the validity, accuracy, or legal status of any such User Status or Direct Messages. In connection with your User Status and Direct Messages made available at the Services, you affirm, represent, and warrant that:
- you own or have the necessary licenses, rights, consents, and permissions to use and authorise us to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all your User Status and Direct Messages to enable inclusion and use of the User Status and Direct Messages in the manner contemplated by the Botim App Services and these Platform Terms; and
- you have a written consent, release, and/or permission of each and every identifiable individual person in the User Status and Direct Messages to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Status and Direct Messages in the manner contemplated by the Botim App Service and these Platform Terms.
33.5 For the avoidance of doubt, you retain all your ownership rights in your User Status and Direct Messages, but you must have the full rights to submit messages in the first place.
33.6 By submitting the User Status to us, you hereby grant us a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Status in connection with the Platform, Services (including the Botim App Services) and the Astra Tech business, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each subscriber to the Botim App a non-exclusive license to access your User Status through the Botim App Services. The foregoing license granted by you terminates once you remove or delete a User Status from the Platform.
33.7 In connection with User Status and Direct Messages, you further agree that you will not:
- submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have legal permission from their rightful owner to post the material and to grant us all of the license rights granted herein;
- publish falsehoods or misrepresentations that could damage any member of the Astra Tech group of company, or any third-party;
- submit material that is unlawful, constitutes adult content, obscene, defamatory, libelous, threatening, harassing, hateful, racially, or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violates any law, or is otherwise inappropriate;
- impersonate another person;
- send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents, or programs;
- interfere with or disrupt the integrity or performance of the Services or the data contained therein;
- attempt to gain unauthorised access to the Platform, Services or its related systems or networks; and
- agree to be bound by the obligations set out in Clause 9 (Acceptance Use).
33.8 We do not endorse any User Status or Direct Message, or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with User Status and/or Direct Messages.
33.9 We do not permit copyright infringing activities and infringement of intellectual property rights via any of our Services, and we will remove any User Status or Direct Message if properly notified that such User Status or Direct Message infringes on another’s intellectual property rights. We may also terminate a user’s access to the Services for repeat infringers. A “repeat infringer” is a user who has been notified of infringing activity previously and who continuously uses inappropriate or infringing User Status and/or Direct Messages. We reserve the right to decide whether a User Status or Direct Message is appropriate and complies with these Platform Terms, the law and our polices (such as, but not limited to, excessive length or limited interest). We may remove such User Status, Direct Messages and/or terminate a user’s access for uploading any material in violation of these Platform Terms at any time, without prior notice and at its sole discretion.
33.10 You understand that when using the Botim App Services, you will be exposed to User Status and Direct Messages from a variety of sources, and that we are not responsible for the accuracy, usefulness, safety or intellectual property rights in or relating to such User Status and Direct Messages, and that such User Status and Direct Messages are not the responsibility or liability of Astra Tech. You further understand and acknowledge that you may be exposed to User Status and Direct Messages that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Astra Tech with respect thereto, and agree to indemnify and hold Astra Tech, its officers, directors, employees, agents, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the Botim App Services.
Part 3 - Terms and Conditions for Wallet Services
34. Wallet Services
34.1 The Services related to the offering and operation of your Botim Money Wallet (as described in this Part 3 – Terms and Conditions for Wallet Services below, comprise the Wallet Services) are provided by Botim Money Technology LLC (Botim Money), a limited liability company established under the laws of the UAE under registration number 3018388. Botim Money’s registered office is at Tamouh Tower 3, Building of Tamouh Investment, Al Reem Island, Abu Dhabi, United Arab Emirates.
34.2 Botim Money is regulated by the UAE Central Bank to provide Stored Value Facilities and carry out certain Payment Services. When opening a Botim Money Wallet you are contracting with Botim Money.
34.3 Once an Botim Money Wallet has been opened, you will be able to hold, send and receive funds through the Platform or by using a “Virtual Card” where one has been issued to you. The Wallet Services available will include:
- Sending and Receiving Payments to other Botim Money Wallets: you may send payments to any other Botim Money Wallet user and you may receive payments to your Botim Money Wallet from any other Botim Money Wallet user. You may also make “cash gifts” to other Botim Money Wallet users which allows you to send a payment to another Botim Money Wallet user, or a group of Botim Money Wallet users which can then be split between the Botim Money Wallet users based on your instruction. You may also be in receipt of a “cash gift” from another Botim Money Wallet user based on their instruction.
- Making domestic and international transfers: you may send payments from your Botim Money Wallet to recipients located in the UAE or internationally. Please refer to Clause 37 (International Transfers) of these Platform Terms regarding International Transfers.
- Making Purchases: you may make purchases from certain participating merchants using our e-commerce service, the QR Code feature (which will require access to the camera on your device) of the Platform. A full list of participating merchants is accessible on the Platform. Where applicable, you may also make purchases from third party sellers using a Virtual Card, provided the third-party seller accepts payments via the card scheme connected to that Virtual Card (please see Part 4 – Terms and Conditions for Card Services). Any shipping or delivery services for goods purchased will be provided by the merchant directly.
- Paying Bills: you may pay a bill owed or request any other Botim Money Wallet user pay the bill for you. Alternatively, you may be requested by another Botim Money Wallet user to pay a bill for them.
- Household Payments: you may use your Botim Money Wallet to make household payments, including to pay domestic workers.
- Adding or Removing Value: there are a number of ways in which you may top up the balance of your Botim Money Wallet or remove value from your Botim Money Wallet, in addition to those listed above. This includes through:
- a bank transfer to or from your nominated bank account;
- a payment instrument, such as a debit or credit card (we accept payments using Visa and MasterCard credit/debit card in AED, or any other agreed currency);
- a cash payment via a Botim Money designated kiosk;
- depositing or withdrawing cash from at a merchant’s premises (note this is not available at every merchant); and
- where your employer has subscribed to the UAE Central Bank’s Wages Protection Scheme, you can also top-up by choosing to receive your salary directly into your Botim Money Wallet.
34.4 Refunds: Please note that when you pay for a Service or buy something from a merchant or third-party seller and the transaction is ultimately refunded, the payment will typically be refunded to the original payment method you used for the transaction. Refunds to the balance of your Botim Money Wallet will generally be processed within one (1) business day. Where the Platform gives you an option to receive your refund into your Botim Money Wallet and you have selected that option in respect of a transaction, any refund will be made into your Botim Money Wallet instantly.
35. Mobile Phone Account Top-up
35.1 In order to complete a mobile phone top-up, you will be required to provide certain information, including the mobile phone number and the amount of top-up that you wish to be delivered and confirm the mobile operator.
35.2 To avoid the Botim App Services being provided to the incorrect phone number or mobile operator, we will ask you to confirm that the recipient details you have entered are correct. It is your sole responsibility to ensure that you have correctly inputted the information.
35.3 The total amount (inclusive of all applicable taxes and charges) that you will be required to pay, and the mobile operator will be displayed clearly on the Botim App before you are asked to confirm your transaction. Proceeding with the transaction at this point is entirely optional.
35.4 The cost of mobile top-up will vary, depending on the amount of top-up that you wish to send according to the denominations displayed on the applications. Where an exchange rate has been applied, the actual amount that you are charged may vary as the payment processors’ foreign exchange rate may be slightly different at the time of settlement. You may also be charged a secure online processing fee in respect of mobile top-up through the application. If you choose to send an optional SMS to the recipient of the top-up, an additional message fee for this service may apply by your telecommunications’ service provider.
35.5 Upon successful payment, the Wallet Services are provided by us via the mobile operator. Occasionally, there may be a short delay before the relevant third party makes the services available to the recipient after successful payment. Where contact details have been provided, we will send you a confirmation direct message which contains details of the available Wallet Services as soon as your transaction has been successfully completed.
35.6 You agree and understand that we only act on your authorisation to send the top-up to the designated phone number and that the relevant third party (telecommunication services provider) shall be solely liable to you and the recipient of the top up for the provision of the mobile services related to the top-up.
35.7 Once a top-up process is completed, it cannot be refunded or removed.
35.8 You understand and agree that you will lose the right to cancel the mobile top-up process once it has been fully completed. Please note that the Wallet Services may limit the number and value of the top up services that can be purchased or received over a specific time period (e.g. daily, weekly, monthly). Other limits and exclusions related to the use of the applications may be applicable from time to time.
36. Use of Your Botim Money Wallet
36.1 When using your Botim Money Wallet, you agree to comply with the following provisions:
- Personal Use: your Botim Money Wallet may only be used for personal use and shall not be used for business or other purposes.
- Your Device and Your Botim Money Wallet: you will only have one Botim Money Wallet and it will be registered to the device you own and have the full rights to use.
- Instructions: you must always ensure that the instructions you give us with respect to your Botim Money Wallet are correct, clear, and lawful. We will act on your instructions in relation to your Botim Money Wallet, unless:
- we have reason to believe that an instruction:
- has not been made by you;
- is ambiguous or unclear;
- is in violation of the law; or
- has been made with fraudulent or criminal intent;
- we are otherwise required by law; or
- you have breached these Platform Terms.
- we have reason to believe that an instruction:
- Hold Payment: we may hold a payment instruction if we reasonably consider it necessary to do so to protect you or your Botim Money Wallet (for example, as a result of the payment exceeding a fraud-related limit) or if we are required to do so for legal reasons.
- Inform you: we will get in touch with you as soon as possible if we have refused to act on your instruction or held a payment instruction for a period of time, unless we are not allowed to for legal reasons.
- Currency: the currency applied to the use of the Wallet Services, including holding funds in your Botim Money Wallet, will be UAE Dirham. However, if you want to send money in a different currency we will apply the currency conversion rate that applies at that time and let you know what that rate is in advance.
- Value Limits: we have the right to impose a limit on the amount of money being used with respect to any of the Wallet Services. For example, we can impose a limit on the amount of money held in your Botim Money Wallet at one time. The limits applicable to your Botim Money Wallet will be displayed on the Platform.
- Other Botim Money Wallet Users: you can identify and connect with other Botim Money Wallet users through the following channels:
- scanning the QR code of another Botim Money Wallet user;
- searching for other Botim Money Wallet users using their mobile numbers; and
- searching for other Botim Money Wallet users using their Botim Money IDs.
Please note that before you connect with other Botim Money Wallet users, we may need to verify their identity.
37. International Transfers
37.1 Our Wallet Services allow you to send an international money transfer (an International Transfer) to individuals or entities located in certain countries offered by us from time to time (the Recipient), for collection in cash, or directly into their international bank account or digital wallet (Collection Method).
37.2 Cash Collection. In order for the Recipient to collect the International Transfer in cash, they must provide the reference number and certain information about themselves, you as the sender, and the International Transfer. You must give the correct details regarding the International Transfer to the Recipient and ensure such details are kept safe and secure and not disclosed to any other party than the Recipient.
37.3 Expired Transfers. If you choose cash as the Collection Method, and the Recipient has not collected the International Transfer amount within 90 days of the transfer request, we will treat the International Transfer as expired and we will have no obligation to execute the International Transfer. In such circumstances, you will be entitled to a refund of the amount of the International Transfer to your Botim Money Wallet and you should contact via email at customerservice@botim.me to process your refund. We aim to process refund requests promptly, and in any event within 30 days. Any fees paid by you in connection with the International Transfer will not be refunded.
37.4 Limits. There are limits on the amount you are able to send via International Transfer. These limits will be displayed on the Platform.
37.5 Timing. For information on the estimated time of arrival of an International Transfer to a Recipient’s bank account or digital Botim Money Wallet, you will need to contact the Recipient’s account provider.
37.6 Currency. International Transfers are debited from your Botim Money Wallet in AED and exchanged into the currency you selected when initiating the International Transfer. You may only send money in the currencies offered by us in our sole discretion from time to time.
37.7 Third Parties. We may process your International Transfer request through a third party that we partner with from time to time. You agree to us sharing information with such third parties for the purpose of processing the transaction and paying out funds to the Recipient.
37.8 Compliance. In accordance with our regulatory obligations, we screen all International Transfers for compliance with applicable laws and regulations. We may request additional information concerning you, the Recipient, and the purpose of the International Transfer. The International Transfer may not be processed until such information has been provided to us.
37.9 Liability. We will not be liable for:
- rejecting or delaying a request for an international transfer, where we reasonably believe that the International Transfer: (i) is illegal or fraudulent in nature; or (ii) will cause to breach of applicable laws, regulatory requirements or our compliance policies and procedures;
- VAT or other taxes that may be imposed to process the transaction, or any charges imposed by the Recipient’s bank account;
- loss or delay associated with your provision of incorrect Recipient or Collection Method information when initiating an International Transfer; or
- loss associated with return of the funds due to non-collection of funds by the Recipient.
38. Protecting Your Funds
38.1 Funds stored in your Botim Money Wallet are protected by us in accordance with our regulatory obligations. We do this by placing your funds in a dedicated account held with a bank licensed by the UAE Central Bank.
38.2 Your funds will continue to be protected until they are paid out or redeemed by you.
39. Fees and Charges
39.1 You will be charged a fee for using certain of our Wallet Services. Information on fees is set out in our Schedule of Charges which is available here.
39.2 We reserve the right to amend our charges at any time by giving you at least sixty (60) calendar days’ notice.
40. International Transfer: Amendments, Cancellations, and Refunds
40.1 You do not have the right to cancel an International Transfer. However, we may be able to cancel it before the Recipient receives or collects the funds. If you wish to cancel the International Transfer, you must contact us as soon as possible at customerservice@botim.me. We aim to process such requests promptly, but we cannot guarantee that cancellation is possible. Any fees paid by you in initiating the International Transfer will not be returned in the event the cancellation request is successfully cancelled and the funds are returned to you.
40.2 For cash pickup transactions, we can make amendments to the Recipient’s name to correct it so that it matches the ID proof provided by you. Complete change of the Recipient’s name is not permitted. In such cases the original transactions need to be cancelled and refunded. To amend the name and account number for bank account and wallet transactions, we will contact the payment processor/processing bank. Amendments may not be possible to the name and account holder and the availability of a refund is subject to processing bank’s policy.
40.3 For cash pickup transactions, if the cash is not picked up by the Recipient then you may raise a request for cancellation. Service charges will not be refunded for cancelled cash pickup transactions. Refunds for cancelled transfers to bank accounts/wallets are subject to the refund policy of the processing bank/wallet provider. Refunds from wrongly credited bank accounts/wallets are subject to debit authorisation from the individual who received funds and also depended on the refund policy of the processing bank/wallet provider.
40.4 Transactions which are cancelled or failed will be refunded automatically back to your Botim Money Wallet. The turnaround time for refund to your Botim Money Wallet is twenty-four (24) hours. We aim to process your amendment, cancellation, and refund request in line with above timeframe, subject to the processing bank’s policies.
41. Botim Money Wallet Statements
41.1 We will inform you of all transactions on your Botim Money Wallet as they occur via SMS or email or via the Platform. You will have access to a record of all transactions that have occurred in your Botim Money Wallet.
41.2 You are responsible for informing us if your contact or identification information changes or confirming such information to us at our request.
Part 4 – Terms and Conditions for Card Services
42. Card Services
42.1 The Services related to the issuance and operation of your Botim Money Card (as described in this Part 4 – Terms and Conditions for Card Services (Card Terms), comprise the Card Services) are provided by Botim Money Technology LLC (Botim Money), a limited liability company established under the laws of the UAE under registration number 3018388. Botim Money’s registered office is at Tamouh Tower 3, Building of Tamouh Investment, Al Reem Island, Abu Dhabi, United Arab Emirates.
42.2 Botim Money is regulated by the UAE Central Bank to provide Stored Value Facilities and carry out certain Payment Services. When opening a Botim Money Card you are contracting with Botim Money as issuer of your Card.
43. The Card Terms Generally:
42.1 Your Card is a stored value card which allows you to access the funds available on the Card (Available Funds). Your Card does not constitute a checking, savings or other bank account and is not connected in any way to any other account you may have with us.
42.2 Your Card is not a debit card or credit card and you will not earn profit or interest on any Available Funds on the Card. You are responsible for all Cards issued to you under your Botim Money Wallet and for any fees or charges that these Cards may incur.
42.3 Your Card is provided to you subject to our Schedule of Charges, and limits as amended and notified to you from time to time. Your Card will be activated when you first load funds on to the Card. Your activation of the Card shall constitute a confirmation by you that you have read and agreed to these Card Terms, the schedule of fees, commission, and charges for usage of the Card.
42.4 Various fees and limits may apply to your Card in respect of each Transaction or daily transacted amounts, please see clause 48 below.
42.5 We may at our sole discretion issue / restrict /withdraw any number of Cards that we have issued to you. Any Card we issue to you is, and remains, our property and must be returned to us immediately upon request.
44. Card Usage
44.1 You may only use your Card in accordance with these Platform Terms, including these Card Terms, and we have the right to restrict the services/facilities provided pursuant to the issue/usage of your Card at our sole discretion and without any prior notice.
44.2 Subject to sufficient Available Funds on your Card and any restrictions in these Card Terms, your Card can be used worldwide at ATMs, point-of-sale terminals or e-commerce website or any card operated machine or device, whether belonging to us or other participating banks or financial institutions where logos appearing on your Card are displayed/ accepted and any other services so authorised on the Card by us. Your Card may also be used at any merchant location that accepts your Card for processing or displays the logo appearing on the Card.
44.3 Subject to these Card Terms (including any applicable value Limit) your Card may be used for retail purchases, cash withdrawals, purchase of goods and services via the internet, telephone, facsimile and mail order or for any other services approved by us (each a Transaction) subject always to your Card having sufficient Available Funds. The Available Funds will be reduced by the full amount of each Transaction plus any applicable charges that may be imposed on the Transaction by the merchant and third-party service providers (such as payment processors).
44.4 Your Card may not operate in some countries and may not be accepted at some merchant locations which are not in compliance with either our internal policies or as determined at our sole discretion.
44.5 Merchants that accept your Card are required to seek authorization from us or through any appointed payment processor for all Transactions that you make and we cannot stop a Transaction once authorised. Some merchants may not be able to authorise your Transaction if they cannot obtain an online authorisation from us.
44.6 There are circumstances, when using your Card at certain merchants, where you may be required to have Available Funds greater than the value of the Transaction you wish to make. This amount will be reserved to cover tips/gratuities, temporarily reducing the balance available on your Card. This is required as the merchant may need to access more funds than you initially planned to spend, however, you will only be charged for the actual and final amount of the Transaction you make.
44.7 We do not recommend using your Card as: (i) a guarantee of payment, for example as a deposit for hotels, cruise lines or car rental, as merchants such as these may estimate the final bill and this amount will be temporarily unavailable to access or spend; or as (ii) an arrangement for periodic billing, as any debits to your Card as a result of such arrangements will be considered to have been authorised by you.
44.8 Your Card is only for your use and expires on the date on the front of the Card. Upon expiry of your Card, your remaining funds will be available in your Botim Money Wallet in accordance with our prevailing policy.
44.9 Your Card will be cancelled if it remains unused for a period of nine (9) months continuously with no available balance.
44.10 You agree not to use your Card in any manner that could damage, disable, overburden, or impair the Card. You also agree not to use your Card for money transfers, accessing or purchasing goods from adult or gambling locations or internet sites, or for any other unlawful activity.
44.11 You must comply with all applicable laws and regulations (including any foreign exchange controls) with respect to your Card in the UAE and any other country in which you use your Card. We reserve the right to suspend your Card and exercise any other remedies available to us should you fail to comply with any part of these Platform Terms, including these Card Terms. You agree that we have no obligation to monitor, review or evaluate the legality of your Transactions and that such actions shall be your sole responsibility. Any usage of your Card inconsistent or in contravention with the usage described in these Card Terms is not permitted.
44.12 We are not liable for any prohibited use or misuse of your Card whatsoever.
44.13 Your Card can only be used if it is in credit, and you are solely responsible for ensuring that there are sufficient Available Funds for an intended Transaction, otherwise the Transaction will be rejected.
44.14 We are entitled to set off any sum of money on your Card due from you to us against any positive balance on any account held by you with us.
44.15 When you pay for a Service or buy something from a merchant or third-party seller using your Card and the Transaction is ultimately refunded, the payment will typically be refunded to the original payment method you used for the transaction. Refunds to Cards linked to your Botim Money Wallet will generally be processed within fourteen (14) business days, however in certain instances the refund may take up to thirty (30) business days. Where the Platform gives you an option to receive your refund into your Botim Money Wallet and you have selected that option in respect of a transaction, any refund will be made into your Botim Money Wallet instantly.
44.16 Our record of any Transaction shall be final and binding. You will not be provided with a printed statement, but may check your Available Funds via the Botim App. You may also be able to make a balance enquiry at some ATMs, although availability is dependent on the country and the ATM used and there may be a fee payable (to the ATM operator) for balance enquiries.
44.17 It is your responsibility to keep track of the Available Funds. You acknowledge that the amount stated on any ATM screen or a printed slip or receipt advice shall not for any purpose whatsoever be taken as a conclusive or up to date statement of the Available Funds on your Card.
44.18 You acknowledge that the Available Funds on your Card may be different from the balance amount as displayed through any channel, due to pending Transactions or other held amounts (being amounts transacted but not processed) relevant to your Card.
45. Loading and Re-loading Your Card
45.1 Your Card can be loaded with additional funds and the Available Funds balance increased via the Botim App or kiosks, selected distributor or alternate channel made available by us. Where your Card is a salary Card (Salary Card), your Card will also be loaded with additional funds when your employer deposits your salary on to your Card.
45.2 Unless stated otherwise, amounts loaded on to your Card will be credited to the Available Funds when we receive such amounts directly or indirectly through the permitted channels.
45.3 You agree to present your Card and meet identification requirements as may be required from time to time to complete the loading process. If the identification verification is not successful, you will not have access to the funds on the Card and will not be allowed to load the Card or make any Transaction.
45.4 If the load amount exceeds the maximum balance of the Card, then at our discretion such excess amounts shall not be loaded on the Card.
45.5 We are authorised to withhold any Card balance or temporarily or permanently block your Card and will not release the funds in relation to such Card balance, if we have reasonable grounds to believe that such funds are from suspicious, illegal or illegitimate sources or if we have reason(s) to believe that you might be on any sanction list. We will contact you to request further information and such other necessary proof (to our satisfaction) on the source of such funds. If we are not satisfied with such information or proof, we are authorised to surrender such amounts, without further notice to you, to the relevant law enforcement authorities for further investigation and/or legal action and/or report you and your Botim Money Wallet to relevant law enforcement authorities without prior notice to you.
45.6 You give us irrevocable authorisation to recover any funds erroneously loaded onto your Card. If an authorised top up to your Card has an error or if you require additional information, you must contact us immediately.
46. Keeping Your Phyiscal Card and Pin Secure
46.1 Where you have been issued with a physical Card, you must sign the back of your Card as soon as you receive it.
46.2 You must do all that you reasonably can to keep your Card safe and the Personal Identification Number (PIN) and Card Verification Value (CVV) and other security details, secret and safe at all times and not disclose them to any third party.
46.3 You must never; (i) allow anyone else to use your Card, PIN or other security details; (ii) write down the PIN or any other security information together with the Card; or (iii) give the PIN or any One-Time-Password (OTP) that we may issue, to anyone, authorised or unauthorised.
46.4 We will never ask you to reveal any PIN.
46.5 The PIN registered to your Card may be disabled if an incorrect PIN is entered three (3) times. If the PIN is disabled, please contact us for assistance via customerservice@botim.me. If the PIN is disabled, or if a merchant does not accept Card and PIN, you will be required to sign for any Transactions at merchants, provided that this is supported by and acceptable to the merchant.
46.6 You must promptly notify us of any loss or theft of your Card or PIN. We will suspend the Card to prevent further use. If a lost Card is subsequently found, it must not be used unless we confirm it may be used. We will not be liable for any misuse of the Card or unauthorised withdrawal arising out of the loss, theft or misuse of the Card or the PIN.
46.7 You can obtain a replacement Card in the event of loss or theft of your Card subject to you providing the necessary documents and information. Issuance of a replacement Card is subject to a fee.
46.8 You will be required to confirm details of any loss, theft or misuse to us and you must assist us, the police, and any other official investigation authority in any enquiries.
46.9 We may refuse to approve a Transaction and/or suspend your Card, with or without notice, if we think the Card has been or is likely to be misused or if you have breached these Platform Terms (including these Card Terms) or if we suspect any illegal use of your Card. If we do suspend your Card, we will inform you of our decision, unless such disclosure is prohibited by law or would otherwise compromise fraud prevention or security measures.
46.10 If you do not adhere to the requirements stated in this clause regarding the safeguarding of your Card, PIN, CVV, OTP and other security details, you may incur financial losses. In such cases, you will be solely responsible for any resulting consequences.
47. Unauthorised Transactions
47.1 You must notify us of any unauthorised Transactions immediately and in any event within thirty (30) days of the Transaction debit date. We will request that you provide additional written information concerning any such Transaction and you must comply with such request.
47.2 You will be liable for all losses in respect of the Card if you have: (i) acted fraudulently; (ii) failed to use your Card in accordance with these Card Terms; (iii) failed to notify us without undue delay on becoming aware of the loss, theft or misuse of the Card; or (iv) failed to take all reasonable steps to keep your Card’s security features safe.
47.3 Where you are not liable for an unauthorised Transaction, we will refund the value of that Transaction and will have no further liability to you for any other losses you may suffer. If our investigations conclude that the Transaction you have disputed has been authorised by you, or on your behalf, or you have acted fraudulently, we will not refund the value of the Transaction.
48. Fees and Limits
48.1 Fees and limits (Limits) apply to your Card, as indicated in the Schedule of Charges. The fees we charge are subject to change from time to time, in accordance with these Card Terms and at our sole discretion. You will be notified of any change in the applicable fees via the Botim App.
48.2 If there are insufficient funds in your Botim Money Wallet to cover the monthly account fee for your Card, the fee will remain payable by you until there is sufficient balance in your Botim Money Wallet. If your Card remains unused for six (6) consecutive months a monthly inactive fee will be charged against your Botim Money Wallet.
48.3 You agree to pay and authorise us to debit your Card and Botim Money Wall for the fees set out in the Schedule of Charges. These fees may be debited from the Available Funds as soon as they are incurred.
48.4 From time to time, we may limit the amount you can load on your Card, or the amount you can withdraw from ATMs or spend at merchants over certain time periods. Some ATM operators also impose their own limits on the amount that can be withdrawn or spent over a specific time period.
48.5 Certain merchants may charge an additional fee if your Card is used to purchase goods and/or services. The fee is determined and charged by the merchant by including it in the Transaction amount and is not retained by Us.
48.6 Dynamic Currency Conversion (DCC) is a process whereby the amount of a Transaction is converted by a merchant or ATM to the currency other than the country’s local currency. In this case, the merchant or ATM operator is applying a foreign exchange margin to the applicable conversion rate that would apply to convert the Transaction currency into another currency. This may result in an increased cost to your Transaction. For instance, you withdraw cash from an ATM that dispenses a currency other than that of the country where the ATM is located, the merchant or ATM operator may convert the cash being withdrawn into the domestic (local) currency before converting it back to the cash being dispensed. It might occur even though the cash being dispended is the same as currency available in your Botim Money Wallet. Thus, the amount debited or reflecting in your account statement may be higher than the amount which is dispensed by the ATM. Not every ATM operator informs of the exact amount to be debited to your Account before you withdraw cash from their ATM.
48.7 In the event that a withdrawal is made from an ATM outside of the UAE, the local currency will be dispensed after applying the necessary conversion rate as per our prevailing policies to dispense the currency of the country where the ATM is located. You acknowledge and accept that any fees, charges, or commissions levied by the bank or any third-party provider in connection with the withdrawal will be deducted from the Card balance.
49. Fee Schedule and Details
49.1 You can find the Schedule of Charges and the other relevant details at Schedule of Charges.
50. Foreign Currency Transaction
50.1 A foreign exchange rate will apply in the following instances: (i) initial load or reload(s) using your Card for a Transaction in a currency which is not AED; (ii) Point-of-Sale terminal Transactions where the Transaction is in a currency other than that of the Available Funds on the Card; (iii) ATM withdrawals where the withdrawal currency is not available on the Card; (iv) in the case where you allocate funds from one Card Currency Wallet (as defined below) to another or where we allocate funds from one Card Currency Wallet to a different Card Currency Wallet in accordance with these Card Terms.
50.2 If a foreign exchange conversion takes place, the conversion will be undertaken at the prevailing exchange rate determined by us when loading or reloading your Card.
50.3 Foreign exchange rates are subject to variation and the rate that applies one day will not necessarily be the same on any other day.
50.4 Additional margins may apply in respect of foreign exchange conversions.
51. Multicurrency Cards
50.1 Cards that support multiple currencies (Multicurrency Cards):
- Each Multicurrency Card will have a nominated base currency of AED (Base Currency) in which all funds will be loaded.
- Each Multicurrency Card will have multiple currency wallets (each a Card Currency Wallet). The balance in each such Card Currency Wallet comprises the Available Funds for the respective currencies.
- Currencies supported by Multicurrency Cards may vary from time to time at our sole discretion.
- When funds are loaded onto the Multicurrency Card, the payment is made by you in the Base Currency, and later we convert that amount into the requested Card Currency Wallet of your choice.
- We may, at our sole discretion, permit funds to be transferred between the Card Currency Wallets available on the Multicurrency Card and each such transfer will be undertaken at our prevailing exchange rates and will be subject to margins for such Transactions determined by us from time to time.
- Transactions will be posted on the Card Currency Wallet that matches the Transaction currency. If the Transaction is made in a currency which is different to any of the available currencies on the Multicurrency Card, then the Transaction amount (including any fees) will be converted into the Base Currency, which is AED.
- If the amount of a Transaction (including any fees) exceeds the balance of the Card Currency Wallet of the currency applicable to the Transaction, the amount (including any fees) will be taken by converting amounts from the other Card Currency Wallets on the Multicurrency Card starting with AED (Default Currency) and proceeding in the order of priority set by you. If you have not set an order of priority, the default priority (Default Priority) shall apply. If the total amount available in all the currencies is insufficient to fund the Transaction (including any fees) then the Transaction will be declined and the amount in all currencies will retain their original value.
- You agree that to recover charges/fees or any outstanding amount due to any reason in any Card Currency Wallet of any Multicurrency Card, we shall have the right to set off such amounts against the balance available on any other Card Currency Wallet of that Multicurrency Card.
- The currencies available in respect of the Multicurrency Card may vary from time to time. Before you make a decision to request for issuance of a Multicurrency Card, please check with us for details of available currencies. We may introduce new currencies from time to time. If we introduce a new currency, the separate terms shall apply to such new currency, and, unless otherwise notified to you, and Schedule of Charges shall be deemed to be amended to apply to such new currency.
- You are responsible for determining the amount held in each Card Currency Wallet on your Multicurrency Card and for ensuring you have sufficient funds for all Transactions.
- If an ATM displays a balance for the Available Funds, this may be displayed in a currency different to the currencies on the Multicurrency Card, in which case the exchange rate applied may be different to ours and a variation may occur. An ATM will not display a balance for each currency available on the Multicurrency Card.
52. Cancelling Your Card
52.1 If you would like to cancel your Card and cease using the Card Services, please submit a formal request through the Botim App. At our option, we may allow you to spend the remaining Available Funds by withdrawing funds at an ATM, spend the funds by transacting at a merchant or, if applicable, you can request your Available Funds be transferred to your nominated account.
52.2 All returns will be net of fees or uncollected Transactions.
52.3 We will pay you your Available Funds in AED currency and balances in any other Card Currency Wallets will be converted using the conversion rate applicable on the closing date. Upon the cancellation of your Card, you may be asked to destroy or return the Card to us. In any event, the Card will be automatically cancelled.
53. Termination of Agreement
53.1 We may cancel your Card and ask for the return of the Card with or without notice, if you breach any of these Platform Terms, including these Card Terms. Upon cancelling your Card, you will no longer be able to use your Card. Where applicable, the cancelling of your Card will not affect your right (if any) to redeem unspent funds.
54. Immediate Termination
54.1 Notwithstanding any other provision contained in these Card Terms, Botim Money may cancel your Card with immediate effect in various scenarios, as provided below but not limited to:
- your breach of any provision of these Card Terms or any other applicable policy of Astra Tech;
- your breach of any applicable laws and regulations;
- in compliance with instructions from appropriate regulatory authorities;
- we detect suspicious or fraudulent activity related to your Card;
- your failure to provide, update, or maintain accurate information, including but not limited to personal identification, address, and contact information;
- any financial distress that impacts your ability to meet your obligations under these Card Terms;
- any legal or regulatory action, claim, investigation, or proceeding involving you or your Card that, in our sole discretion, may adversely affect our reputation or expose us to any liability;
- your failure to maintain a minimum balance or meet other account requirements as specified by us from time to time;
- your misuse or abuse of your Card, the Platform, or the Services, including but not limited to using the Card for unlawful or prohibited activities;
- repeated chargebacks, declined transactions, or other indications of poor financial management;
- your violation of any third-party rights, in connection with your use of your Card or any of the other Services;
- your non-payment of any fees, charges, or penalties owed to us under these Card Terms or any other applicable policy; or
- any other circumstances that, in Botim Money’s sole discretion, warrant immediate cancellation of your Card to protect its interests, other users, or the public.
Part 5 – Terms and Conditions for Lending Services
55. Quantix Lending and Consumer Financing Services
55.1 The Services related to the offering and operation of lending and consumer financing services available through the Platform (as described in this Part 5 – Terms and Conditions for Lending Services comprise the Lending Services) are provided by Quantix Technology Projects LLC (Quantix), registered in Abu Dhabi, UAE, with registration number CN-3762786. Quantix’s whose office is at a private limited liability company incorporated in the Emirate of Abu Dhabi with commercial license number CN-3762786, and with a registered office at Tamouh Tower, Al Reem Island, Abu Dhabi, UAE.
55.2 Quantix is regulated by the UAE Central Bank to provide lending and consumer financing services. When using the Lending Services to borrow money you are contracting with Quantix.
56. Provision of the Quantix Lending and Consumer Financing Services
56.1 If you apply to access the Lending Services and we agree to provide you access to the Lending Services, you agree that such Lending Services will be governed by this Part 5 – Terms and Conditions for Lending Services (Lending Terms) and the terms and conditions set out in the credit agreement applicable to your loan (Credit Agreement) and the any other documentation we may require you to sign as part of the Loan approval process, including an auto debit agreement (Auto Debit Agreement) authorising us to automatically deduct payments from your accounts and wallets with us and with other parties. To the extent of any inconsistency between these Platform Terms, including these Lending Terms, the Credit Agreement and the Debit Agreement, the terms of the Credit Agreement shall prevail.
57. Credit Decisions
57.1 Credit decisions, including the approval or denial of Lending Services, are at our sole discretion. We are not obligated to provide any reasons for our credit decisions, and you acknowledge and agree that we shall not be liable in any way for the decision to grant or not grant credit or for any consequences arising from such decisions, including, but not limited to, any financial loss or damage, denial of opportunities, or any other adverse effects.
58. Quantix Fees and Charges
58.1 The fees for the Lending Services and any additional fees, such as late payment fees, will be as set forth in the relevant Credit Agreement and the related key facts statement (KFS) that we will provide to you as part of the Loan approval process.
59. Loan Statements
59.1 We will inform you of all transactions on your Loan as they occur via SMS or email or via the Platform. We will also provide you with regular statements free of charge showing all transactions that have occurred in your Loan. You are responsible for checking the accuracy of the statements sent to you.
59.2 You are responsible for informing us if your contact or identification information changes or confirming such information to us at our request.
60. Consent to Collection Activities
60.1 By using the Lending Services, you acknowledge and consent to our conducting collection activities in accordance with applicable laws and regulations, as well as these Platform Terms and any applicable Credit Agreement, in the event of any default or failure to repay any amounts owed to us in accordance with the terms of the Auto Debit Agreement.
60.2 Collection activities may include, but are not limited to, contacting you through phone calls, emails, text messages, or other communication methods, employing third-party collection agencies, and reporting any delinquencies or defaults to credit reporting agencies. You also agree that we may contact the references you provided during the application process for the Services to assist in collection activities or to verify your information. You agree to cooperate with us and any third-party collection agencies in resolving any outstanding balances or disputes and to provide accurate and up-to-date contact information for the purpose of collection activities.
60.3 You acknowledge and agree that we may obtain and report such information to any licensed and/or authorised credit bureau in the UAE, including but not limited to Al Etihad Credit Bureau (AECB). In particular, you agree that:
- You hereby entitle and authorise (Consent) to us obtaining and disclosing any of your financial, legal or credit information, including any information pertaining to your address, telephones or utility bills or any other information which is included in the credit information report, to verify, obtain or disclose such information as we deem fit in our absolute discretion.
- You agree that we may obtain, request, transfer and disclose any information relating to you (including information we obtain from any third parties such as any local or international credit bureau), to and between our subsidiaries, affiliates and agents and any third parties selected by any of them or us, wherever situated, for private use (including for use in connection with the provision of any loan to you and for data processing, statistical and risk analysis purposes. You and any affiliates, agents or any third parties selected by any of them or you, shall be entitled to obtain, transfer and disclose any of your credit, legal or financial information.
- Without prejudice to the foregoing, you authorise us, without the need to get any written or oral permits, to obtain or disclose any of the information indicated in this Consent from any governmental or semi-governmental authorities, body, organization, company, credit bureau or telecommunications company and any service provider such as electricity, water and telecommunication companies, or any other person or entity as it is needed, whether inside the UAE or abroad, which maintain or are supposed to maintain any of the information contained in this Consent relating to you. We may, pursuant to this Consent, communicate with such bodies to obtain or disclose any of information mentioned in this Consent.
- We shall be entitled to use any or all of the information contained in this Consent for the purpose of granting/or commencing to grant you the Services or to use this information for the purpose of assessing your credit position and collect any amounts or loans payable to us. This Consent shall remain in force and effect against you and may not be terminated or amended without our prior written consent.
- You agree to Astra Tech, our officers and agents disclosing information relating to your Loan and/or dealing relationship(s), including but not limited to details of any credit facilities, any security taken, transaction undertaken, balances and positions with us or any affiliate of ours, to:
- professional advisors and service providers of the permitted parties who are under a duty of confidentiality;
- any actual or potential participant or sub-participant in relation to any of our rights and/or obligations under any agreement with you, or any assignee, novate or transferee (or any agent or adviser of any of the foregoing);
- any rating agency, credit information bureau (whether inside the UAE or abroad) including the AECB, insurer or insurance broker, or direct or indirect provider of credit protection to any permitted party; and
- any court or tribunal or regulatory, supervisory, governmental, or quasi-governmental authority with jurisdiction over the permitted parties.
- You authorise and allow us to inquire from banks and other financial institutions, your employer, or any other body as we deem appropriate about any financial and non-financial information relating to you including but not limited to the details of banking facilities, the financial position, the income, and any other information relating to you which we deem appropriate without reference to you.
- This Consent shall be subject and interpreted in accordance with the Federal Credit Information Law No. 6 of 2010.
Part 6 - Glossary
61. Glossary of Terms Used In These Platform Terms
The following terms are used in these Platform Terms:
- Account: means an account opened in order to make use of the Botim App Services.
- AECB: means the Al Etihad Credit Bureau.
- AI Tools: means artificial intelligence–enabled technologies, machine-learning systems, large language models, generative tools, automated decision-making software.
- AI Output: means text, analyses, data, images, audio-visual materials, recommendations, statistics, code, or any other output or derivative work produced, suggested, or assisted by AI Tools.
- Available Funds: the funds available on the Cards for Transactions.
- Auto Debit Agreement: means the agreement signed by a borrower that authorises the automatic deduction of payments from an account for the repayment of a loan or debt.
- Base Currency: means United Arab Emirates dirham (AED) and is used for determining the aggregate value of the funds on a Multicurrency Card.
- Botim: means Algento DMCC, a subsidiary of Astra Digital Holdings Ltd.
- Botim App: the mobile application provided by Botim.
- Botim App Services: means the various application based services available through the Botim App.
- Botim Money: means Botim Money Technology LLC, a subsidiary of Astra Digital Holdings Ltd.
- Botim Money Wallet: a stored value service provided by Botim Money via the Botim App.
- Cards: means, depending on the context, cards issued by Botim Money, including Salary Cards, Virtual Cards, and Multicurrency Cards.
- Card Currency Wallet: means, in respect of Multicurrency Cards, the Wallet in which a currency is held.
- Card Services: means the issue and operation of virtual and physical Cards.
- Card Terms: means the terms and conditions within the Platform Terms that are applicable to the use and operation of Cards issued by Botim Money.
- Charges: means the fees payable for the use of the Services.
- Collection Method: means in respect of an International Transfer, the method used by a Recipient for the collection of the transferred funds and may include in cash, or directly into their international bank account or digital wallet.
- Consent: in the context of the Lending Services, means the consent granted by a user of the Lending Services for Quantix to obtaining and disclosing any of that person’s personal, financial, legal or credit information which is included in a credit information report.
- Credit Agreement: means the additional agreement between a user of the Lending Services (Borrower) and Quantix that sets out the specific terms and conditions of the Loan.
- Default Currency: means AED.
- Default Priority: means in respect of Multicurrency Cards, the order of Card Currency Wallets that Botim Money will access to make up any payment shortfall for a Transaction.
- Direct Messages: refers to text, voice, photo, video, location and contact information messages you send directly to other users or groups of the Botim App Services.
- Dynamic Currency Conversion: mean the process whereby the amount of a Transaction is converted by a merchant or ATM to a currency other than the country’s local currency, for example where foreign currency is withdrawn from an ATM.
- Intellectual Property: intellectual property rights, including all copyrights, trademarks, domains, logos, trade secrets, patents, and other intellectual property rights that have existed, do, may or will exist in the future.
- International Transfer: means a transfer of funds to individuals or entities located in certain countries offered by us from time to time.
- KFS: means a statement setting out the key facts of a financial product.
- Loan: means a personal loan issued by Quantix as part of the lending and consumer financing services offered by Quantix under the Lending Services.
- Lending Services: lending and consumer financing services offered by Quantix.
- Limits: the financial limits imposed on the use of a Botim Money Wallet or Card from time to time by Botim Money.
- Mini Programs: are sub-applications within the Botim App that may be supported an Astra Tech entity or a third party.
- Multicurrency Cards: means Cards that support multiple currencies through the use of Card Currency Wallets which comprise the Available Funds in the respective currencies offered by the Card Services.
- OTP: means one-time-password used in two factor authentication processes.
- Platform Terms: means the terms and conditions under which we offer you access to the Services.
- Platform: means the Botim App.
- PIN: means personal identification number.
- Quantix: means Quantix Technology Projects LLC, a subsidiary of Astra Digital Holdings Ltd.
- Recipient: means in respect of an International Transfer, the person or entity that receives the funds.
- Repeat Infringer: means someone who repeatedly breaches the Platform Terms.
- Salary Card: means a Card obtainable through an employer and issued for the receipt of salaries.
- Services: means the Botim App Services, Botim Money Wallet, the Card Services and Lending Services.
- Transaction: in respect of the Card Services means the use of a Card to make retail purchases, cash withdrawals or purchases of goods and services.
- UAE: United Arab Emirates.
- User Status: is a Botim App Services that refers to profile photo and other communications other than Direct Messages submitted by you, as well as the automatic submission of your “last seen” status.
- Virtual Card: means a card linked to a Botim Money Wallet that enables users to make Card Transactions using their Botim Money Wallet.
- Wallet Services: means the Services available through the Botim Money Wallet.
